1. Acceptance of These Terms

These Website Terms of Use (the "Terms of Use") govern access to and use of the website operated by World Vision Canada (the "Site").

By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Site.

These Terms of Use govern general use of the Site. Separate terms may apply to donations, purchases, event registrations, sponsorship-related transactions, subscriptions, contests, promotions, applications, accounts, or other specific services made available through the Site. Where separate terms apply, those terms will govern in the event of any inconsistency with these Terms of Use.

2. About World Vision Canada

In these Terms of Use, "World Vision Canada", "we", "us" and "our" mean World Vision Canada and its affiliates, as applicable.

World Vision Canada is a charitable organization that operates the Site to provide information about its mission, programs, campaigns, fundraising activities, gift catalogue, events, sponsorship opportunities and related services.

World Vision Canada seeks to make its digital services accessible and encourages users who encounter accessibility barriers or require accommodation or an alternative means of access to contact us using the contact information below.

3. Changes to These Terms of Use

We may update these Terms of Use from time to time to reflect changes in the Site, our activities, legal requirements, or operational practices.

Non-material changes may become effective when posted to the Site. If we make material changes, we will take reasonable steps to bring those changes to users’ attention, such as by posting a notice on the Site or, where appropriate, by notifying registered users directly.

Your continued use of the Site after the effective date of an updated version constitutes acceptance of the updated Terms of Use, except where additional consent is required by law or where separate, transaction-specific assent is required.

4. Related Policies and Incorporated Terms

Your use of the Site is also subject to our:

  • Privacy Policy;
  • Cookie & Web Technologies Notice;
  • Transactional Terms, where you make a donation, purchase, register for an event, sign up for a recurring payment arrangement, enroll in sponsorship-related payments, or engage in another transaction through the Site; and
  • any contest rules, campaign rules, community guidelines or feature-specific terms made available in connection with a particular promotion, initiative, service or function.

If there is a conflict between these Terms of Use and any more specific terms applicable to a particular service or transaction, the more specific terms govern in relation to that service or transaction.

5. Eligibility and Permitted Use

You may access and use the Site only for lawful purposes and in accordance with these Terms of Use.

You agree to use the Site only for personal, informational, charitable-support, or other lawful purposes that are consistent with the nature of the Site and the services made available through it.

You must not use the Site in any way that:

  • violates any applicable law, regulation or third-party right;
  • is fraudulent, deceptive, abusive, harassing, defamatory, obscene, hateful or otherwise objectionable;
  • disrupts, interferes with, damages, disables, overburdens or impairs the Site or related systems;
  • attempts to gain unauthorized access to accounts, systems, data, networks or services;
  • introduces malware, malicious code, viruses, bots or harmful material;
  • uses automated means, including spiders, crawlers, scrapers, indexing tools or harvesting tools, except as expressly authorized in writing by World Vision Canada;
  • uses the Site or any Content to train, develop, fine-tune, validate or otherwise support artificial intelligence, machine learning, large language model, data-mining or similar systems without prior written authorization from World Vision Canada;
  • reproduces, republishes, frames, mirrors, modifies, sells, licenses, distributes or commercially exploits the Site or any part of it except as expressly permitted;
  • could harm, exploit, misrepresent or endanger children or vulnerable persons;
  • suggests endorsement, sponsorship or affiliation by World Vision Canada where none exists.

6. Intellectual Property

Unless otherwise stated, the Site and all content on the Site, including text, images, photos, stories, illustrations, videos, audio, software, designs, logos, trade-marks, service marks, graphics, page layouts, compilations and other materials (collectively, "Content"), are owned by or licensed to World Vision Canada and are protected by applicable intellectual property laws.

No right, title or interest in or to the Site or any Content is transferred to you, other than a limited, revocable, non-exclusive, non-transferable right to access and use the Site in accordance with these Terms of Use.

Except with our prior written permission, you must not copy, reproduce, publish, display, transmit, distribute, modify, create derivative works from, reverse engineer, commercially exploit or otherwise use any Content, except for limited personal, non-commercial use that does not remove proprietary notices and does not otherwise violate these Terms of Use.

7. Child Images, Beneficiary Content and Safeguarding

World Vision Canada is committed to safeguarding children and vulnerable individuals in the communities we serve.

Images, videos, stories, names, letters, biographies and other materials relating to children, families and communities served by World Vision Canada may be subject to heightened restrictions. Except as expressly authorized in writing, such materials must not be copied, reproduced, redistributed, embedded, commercially used, altered, posted on third-party platforms, or otherwise used in a way that compromises dignity, privacy, safeguarding or our policies.

Nothing in these Terms of Use permits the use of child images or beneficiary-related materials in a manner inconsistent with safeguarding obligations or applicable law.

8. User Accounts and Credentials

Certain features of the Site may require you to create an account, provide login credentials, or otherwise identify yourself.

If you create an account or use any credential-protected feature, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account, except to the extent caused by our failure to use reasonable safeguards.

You agree to provide accurate, current and complete information and to update it as needed.

We reserve the right to suspend, restrict or terminate access to any account or credentials if we reasonably believe that there has been a breach of these Terms of Use, misuse of the Site, fraud, unauthorized activity, or a security concern.

Individuals who discover a security vulnerability affecting the Site are encouraged to report it responsibly to World Vision Canada using the contact information below. You must not exploit, test beyond what is necessary to confirm the vulnerability, access or alter data without authorization, disrupt the Site, or disclose or publicize a vulnerability without authorization.

9. User Submissions and User-Generated Content

If the Site permits you to submit or upload content, including comments, testimonials, fundraising content, event content, photos, text, feedback or other materials ("User Content"), you represent and warrant that:

  • you have all necessary rights, permissions and authority to submit the User Content;
  • the User Content does not infringe any person’s rights, including privacy, confidentiality, intellectual property or publicity rights;
  • the User Content is not unlawful, deceptive, defamatory, abusive, harmful, exploitative, obscene or otherwise objectionable;
  • the User Content does not contain malware or harmful code.

By submitting User Content, you grant World Vision Canada a non-exclusive, worldwide, royalty-free, transferable, sub-licensable licence to host, use, reproduce, adapt, format, display, communicate, publish, distribute and otherwise use that User Content for the purpose of operating, administering, promoting, improving and protecting the Site, related campaigns and associated charitable activities, subject to our Privacy Policy where personal information is involved. This licence continues for as long as reasonably necessary for those purposes, including reasonable archival, legal, safeguarding, compliance and record-keeping purposes.

We may monitor, moderate, remove or refuse User Content at our discretion, but we are not obligated to do so.

10. Feedback

If you provide suggestions, ideas, comments or other feedback regarding the Site or our services, you agree that World Vision Canada may use that feedback without restriction or compensation to you, provided that personal information is handled in accordance with our Privacy Policy.

11. Links to Third-Party Sites

The Site may contain links to third-party websites, platforms or services for convenience only.

World Vision Canada does not control and is not responsible for the content, availability, accuracy, policies, practices or security of third-party sites or services. A link to a third-party site does not imply endorsement, sponsorship or affiliation unless expressly stated.

Your dealings with third parties are solely between you and the third party, and you access third-party sites at your own risk.

12. Linking to the Site

You may link to the Site in a lawful and fair manner that does not suggest endorsement, affiliation or sponsorship where none exists and does not damage or take unfair advantage of World Vision Canada’s reputation.

You must not:

  • frame or mirror the Site;
  • link to the Site from any website or media containing unlawful, defamatory, exploitative, deceptive, hateful, obscene or inappropriate material;
  • use our logos, trade-marks or other branding without permission;
  • link in a way that may harm children, vulnerable individuals, or the dignity of communities shown on the Site.

We reserve the right to require that any link to the Site be removed.

13. Accuracy, Availability and Informational Nature of the Site

We strive to keep the Site and its Content accurate and current. However, the Site and all Content are provided on an "as is" and "as available" basis.

Without limiting the generality of the foregoing:

  • Site content may from time to time be incomplete, outdated, unavailable or inaccurate;
  • features, pages, products, services, events, campaigns or opportunities described on the Site may change without notice;
  • access to the Site may be interrupted, restricted or unavailable from time to time.

Except where expressly stated otherwise in writing, the Site and its Content are provided for general informational purposes only and do not constitute legal, tax, financial, accounting, medical or other professional advice.

14. Donations, Purchases and Other Transactions

General use of the Site is governed by these Terms of Use. Donations, purchases, event registrations, recurring payment arrangements, sponsorship-related payment arrangements, subscriptions and other transactional interactions with the Site are governed by our Transactional Terms, which are incorporated by reference where applicable.

15. Privacy and Cookies

Our collection, use, disclosure, storage and protection of personal information are governed by our Privacy Policy.

Our use of cookies, analytics tools and similar technologies is described in our Cookie & Web Technologies Notice.

By using the Site, you acknowledge that personal information may be handled as described in those documents.

16. Force Majeure and Operational Disruptions

World Vision Canada will not be responsible for any failure, interruption, delay, suspension, restriction, unavailability or impaired performance of the Site, Content, functionality or related services where the issue results from circumstances beyond its reasonable control. These circumstances may include natural disasters, weather events, public health events, telecommunications or internet outages, cybersecurity incidents, governmental actions, labour disruptions, supplier or service-provider failures, security incidents, war, terrorism, civil unrest, legal or regulatory changes or similar events.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all Content, functionality and services made available through the Site are provided without representations, warranties, conditions or guarantees of any kind, whether express, implied, statutory or collateral, including any implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, completeness, availability, compatibility, or uninterrupted operation.

World Vision Canada does not warrant that the Site will be secure, error-free, uninterrupted, accurate, current, or free of harmful components, or that defects will be corrected.

18. Limitation of Liability

To the fullest extent permitted by law, World Vision Canada and its affiliates, directors, officers, employees, volunteers, agents, licensors and service providers will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of revenue, profits, business opportunity, goodwill, anticipated savings, data or use, arising out of or in connection with:

  • the Site or any Content;
  • access to, inability to access, or use of the Site;
  • any third-party site or service linked to the Site;
  • these Terms of Use;
  • any reliance on the Site or its Content.

To the fullest extent permitted by law, the aggregate liability of World Vision Canada for direct damages arising from general use of the Site will not exceed the greater of:

  • CAD $100; or
  • the amount, if any, paid by you specifically for the applicable transaction giving rise to the claim, where no separate transactional limitation applies.

Nothing in these Terms of Use excludes or limits any liability, statutory warranties, consumer-protection rights, accessibility rights, privacy rights, payment-card rights or other legal rights or remedies that cannot lawfully be excluded, limited or waived under applicable law.

19. Indemnity

You agree to indemnify, defend and hold harmless World Vision Canada and its affiliates, directors, officers, employees, volunteers, agents and service providers from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • your breach of these Terms of Use;
  • your misuse of the Site;
  • your violation of any law or third-party right;
  • any User Content submitted by you.

20. Suspension, Restriction and Termination

We may suspend, restrict or terminate your access to the Site, or any part of it, at any time and without liability if we reasonably believe that:

  • you have breached these Terms of Use;
  • your use of the Site poses a security, legal or reputational risk;
  • necessary maintenance, system changes or operational reasons require such action.

Sections that by their nature should survive termination or suspension will continue to apply, including intellectual property, disclaimers, limitations of liability, indemnity, governing law and general provisions.

21. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any rights that may not lawfully be waived, you agree that the courts of Ontario shall have exclusive jurisdiction in relation to disputes arising out of or in connection with these Terms of Use or your general use of the Site.

22. General Provisions

If any provision of these Terms of Use is held to be invalid, illegal or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will remain in full force and effect.

No failure or delay by World Vision Canada in exercising any right or remedy constitutes a waiver.

These Terms of Use, together with any incorporated policies and any applicable specific terms, constitute the entire agreement between you and World Vision Canada with respect to general use of the Site.

23. World Vision Canada Fundraising and Impact Updates Text Message Program

World Vision Canada (“we”, “us” or “our”, as appropriate) communicates by text message with donors, supporters and other individuals who choose to receive marketing, fundraising and other communications from us by text message (the “Program”). By opting in to the Program, you agree to these terms (the “Program Terms”), as well as our Terms and Conditions and Privacy Policy.

General

If you are an existing donor, you may receive SMS fundraising appeals from World Vision Canada. You may also opt in to receive impact updates through the Program by visiting our sign-up page.

We may send text messages for marketing, fundraising and donor engagement purposes, including to make you aware of opportunities, events, appeals, updates and other information that we believe may be of interest to you. We may also send text messages to provide updates related to any issues with your recurring monthly donations made to World Vision Canada.

Message frequency may vary. Standard message and data rates may apply.

No purchase or donation is necessary to participate in the Program. Opting in to the Program is not a condition of making a donation to, or otherwise supporting, World Vision Canada.

World Vision Canada reserves the right to suspend or terminate your participation in the Program at any time.

Unsubscribing from the Program

You may unsubscribe from the Program at any time by replying to our text messages with the word STOP or ARRET. After we receive your request, you will receive an additional message confirming that your request to unsubscribe from the Program has been processed.

Unsubscribing from the Program will not unsubscribe you from marketing communications sent by email. To unsubscribe from email communications, please use the “Unsubscribe” link included in the email you received or contact us at info@worldvision.ca⁣.

If you have asked us to stop sending promotional communications by email or text message and continue to receive them, it may be because the email address or phone number receiving those communications is not the same email address or phone number from which you submitted your request.

Help and Customer Support

You may reply to our text messages with the word HELP or AIDER for assistance. You may also contact us by email at info@worldvision.ca⁣, by telephone at 1-866-595-5550⁣, or by visiting our Contact Us page to learn more about the ways you can reach us.

Providing Accurate Information to World Vision Canada

You represent that you are the account holder of the phone number that you provide to us. If you have a Canadian phone number and you change or deactivate that number, you agree to promptly notify World Vision Canada by contacting us through our Contact Us page.

Liability

World Vision Canada disclaims liability for circumstances that may limit or prevent your participation in, or use of, the Program, including the malfunction of any computer component, software or communications line; the loss or unavailability of a communications network; actions taken by applicable wireless carriers; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network.

Changes to the Program or Program Terms

World Vision Canada reserves the right to cancel or suspend the Program, without prior notice, for any reason.

We review and update our policies and procedures as required to remain current with applicable rules and regulations, new technologies, standards and feedback. The Program Terms may therefore change from time to time, and the current version of the Program Terms will be posted on our website. Your continued enrolment in the Program constitutes your acceptance of any changes to the Program Terms.
